On the surface, this week's ruling by the Ninth Circuit court of appeals - overturning the death sentences of more than 100 inmates in Arizona, Montana, and Idaho - is the latest sign of statistical retreat for capital punishment in America.

Reflect Americans' ambivalence about a penalty that most still believe in but are more hesitant to inflict. On the one hand, legislatures are enacting tough-on-crime laws. Attorney General John Ashcroft has been an active proponent of tough sentencing. And 74 percent of Americans favor the death penalty for a person convicted of murder, according to the latest Gallup Poll in May. (The number drops to 53 percent when life without parole is an alternative.)

A four-year legal odyssey that engulfed an entire Panhandle town in a firestorm of controversy came to an end Friday when Gov. Rick Perry pardoned 35 men and women convicted in the controversial 1999 Tulia drug sting.

The cases broke down in March when Coleman gave contradictory statements during evidentiary hearings in Tulia. The testimony led the judge to stop the hearings and recommend the cases of everyone convicted in the bust be overturned. Coleman has since been indicted on perjury charges.<br><br>"Tulia has become a model for what's wrong with the criminal justice system," said Gupta, who helped line up prominent attorneys to join the fight. "It's been so compelling nationally because of the story it tells. What is now needed is for local, state and federal authorities to examine what happened there and put into effect reforms that will keep it from happening again."

He is a known member of a militia group that was involved in a shoot-out with law enforcement authorities. He opposes gun control efforts of the present national government, as well as restrictions on open immigration into this country. He is a businessman who has earned his fortune from such businesses as alcohol, tobacco, retailing, and smuggling."

I was infuriated. As someone acknowledged throughout the world as a specialist in how drugs affect the brain, I know a great deal about cannabis, and I know that the facts are not there to stand up such an outrageous statement.

Government has a boundless appetite to inflict senseless pain on Americans, in the guise of the war on drugs, even at the cost of degrading Federalism and the needs and values of the American people. A recent case demonstrates this arrogance handily.

Ed Rosenthal was a medical marijuana supplier who, in compliance with the California Compassionate Use Act, had been growing marijuana for seriously ill people under a doctor's advice and care. Rosenthal was arrested in February, 2002 and accused of supplying marijuana to the Harm Reduction Center in San Francisco. Rosenthal had been deputized by the city of Oakland, California and made the official supplier of a city-sponsored medical marijuana dispensary. The Compassionate Use Act passed with 78 percent of the vote in San Francisco. It took a total of eighty jurors to find twelve willing to convict Rosenthal. Most of those summoned for jury duty said they would not be willing to brand someone a felon for growing or distributing medical marijuana...
