A New Jersey medical facility will pay $3.6 million to settlement a federal lawsuit over allegations that it billed for tests that weren't medically necessary, U.S. Attorney Paul Fishman recently said.

Garden State Cardiovascular Specialists P.C., which operated several facilities in the sate under the name NJ MedCare and NJ Heart, allegedly sent in Medicare claims for certain cardiology diagnostic tests and procedures, external counterpulsation and cardiac catheterizations, which weren't necessary for the patients, Fishman said. The company's principals, Jasjit Walia and Preet Randhawa were also named in the lawsuit.

The Senate struggled to prevent an interruption in critical government surveillance programs early Saturday, rejecting both a House-passed bill and a short-term extension of the USA Patriot Act.

The White House has pressured the Senate to back the House bill, which would end the National Security Agency's bulk collection of domestic phone records. Instead, the records would remain with telephone companies subject to a case-by-case review. The vote was 57-42, short of the 60-vote threshold to move ahead.

The settlement reached a mutually-agreed upon $800,000 to be paid to the parents in question, who said their civil rights had been violated. The lawsuit claimed that the children were wrongfully removed from their San Gabriel Valley home, some four years ago. The police had no warrant to take the children, but they were nevertheless kept by the state for four months.

Gov. Jerry Brown, who preserved religious exemptions to state vaccination requirements in 2012, on Wednesday appeared open to legislation that would eliminate all but medical waivers.

The governor's new flexibility highlighted a growing momentum toward limiting vaccination exemptions partly blamed for the state's worst outbreak of measles since 2000 and flare-ups of whooping cough and other preventable illnesses.
