A death panel for limited government, brought to you by the living Constitution.

Last week, two-thirds of Ohioans voted against letting the government force people to buy health insurance. The measure passed by a greater margin than the collective bargaining initiative, which grabbed most of the headlines, failed. Ohio's state constitution now rejects the individual mandate central to both the president's federal health care program and the Massachusetts law on which it was partially based.

The three-judge panel of the Sixth U.S. Circuit Court of Appeals upheld the individual mandate in its first ruling on the national health care legislation President Obama signed into law.

"Congress had a rational basis for concluding that the minimum coverage provision is essential to the Affordable Care Act's larger reforms to the national markets in health care delivery and health insurance," Judge Boyce F. Martin, appointed by former President Jimmy Carter, wrote for the majority in the 2-1 ruling, the Associated Press reported. A George W. Bush appointee voted with him and a Ronald Reagan appointee dissesnted.

Today a three-judge panel of the U.S. Court of Appeals of the 11th Circuit is hearing oral arguments about the constitutionality of the federal health care bill signed into law by President Obama.

Florida has joined 25 other states and the National Federation of Independent Business in filing a lawsuit arguing that the individual mandate is unconstitutional. Just now on television I heard a supporter of the lawsuit arguing, "The issue goes beyond health care. If Congress can force people to buy a product, what can't they do?"

More of the same. A LOT more of the same. In fact, every negative aspect of the Bush Administration has come back with a vengeance in the presidency of Barack H. Obama.

The election of President Obama was in no small part, a referendum on the administration of George W. Bush, and his victory was interpreted as a sound rebuke to eight years of open ended warfare, a vast and growing police state, the destruction of civil liberties, disregard for the Constitution, unchecked executive power, lies and broken promises, hypocrisy and arrogance, a lack of transparency in government, out-of-control federal spending, fever-pitch fearmongering, rampant corruption, and some really stupid gaffes. But what have we gotten instead?

Last Month, President Barack Obama revealed plans to import tens of thousands of Syrian immigrants - some who could conceivably be terrorists in disguise - into the United States.

Today, we have obtained a document from the State Department that lists the 180 resettlement centers where these refugees are headed. When refugees arrive in the United States, they stay at these centers until they are able to acquire work, housing, etc., all of which are funded by American taxpayers.

Yesterday many US newspapers carried front-page stories on the severity of influenza so far this season. The New York Times story began with "It is not your imagination - more people you know are sick this winter, even people who have had flu shots."

Is this really a bad flu season? Before we answer that question, I would like to complain about what the Times wrote: 'more people you know are sick this winter, even people who have had flu shots". A similar sentiment appeared in a recent Forbes column "Influenza-like-illness is sweeping the country with the Centers for Disease Control & Prevention reporting that most areas of the country experiencing high rates. I should know, my family is in the midst of it despite having been vaccinated." Remember that having a respiratory illness does not mean that you have influenza - it could be caused by a number of other viruses which of course would not be blocked by influenza vaccine. Furthermore, the influenza vaccine is not 100% effective - it's about 60-70% effective in individuals younger than 65 years.

Two "mothers yesterday lost their battle to stop their children from being forced to have the controversial MMR vaccination, in a ruling which branded their medical expert's evidence 'junk science,' " reported London's daily Guardian, on July 31.

"The case was taken to the high court by the fathers of the two girls, aged 5 and 10, who want their daughters to have the full range of vaccinations. The judgment will not directly affect the pending compensation fight on behalf of more than 1,000 children with brain damage whose parents blame the vaccine, but it raises questions about how easy it will be to muster scientific evidence to support their claim," the daily reported.
